Terms of use
Last updated October 16, 2026
These terms apply when you use the Podstill app or podstill.ai. They’re an agreement between you and Podstill – Marvin Splitt (“we”, “us”), run by Marvin Splitt as a sole trader in Germany. By creating an account or using the app, you agree to them. How we handle your data is explained in the privacy policy.
The short version
- Podstill writes AI summaries of episodes from the podcasts you follow. They can contain mistakes, so check the episode for anything important.
- You sign in with a code we email you, and you can delete your account in the app at any time.
- Apple sells our plans and top-ups, charges for them and handles refunds. Subscriptions renew until you cancel them in your Apple Account settings.
- Podstill is for your personal use. Don’t misuse it or try to get around its limits.
- German law applies, and you keep the consumer protections of the country you live in.
What Podstill is
Podstill is an app that writes short, AI-generated summaries of podcast episodes, which we call gists. You choose the shows: Podstill works with podcasts that publish a public RSS feed. A gist sums up an episode and links to its key moments by timestamp. When you play a moment, or the whole episode, the audio streams straight from the publisher’s feed.
Podstill isn’t affiliated with, endorsed or sponsored by the podcasts it summarizes. The podcasts, their audio, artwork and descriptions belong to their owners. To write a gist, we transcribe the episode, but we never show you the transcript. If you make a podcast and have a concern about how Podstill handles it, write to info@podstill.ai.
Your account
- You sign in with your email address. Each time, we email you a 6-digit code to enter in the app. There’s no password.
- One account per person, for yourself only. Don’t share your account or use someone else’s.
- Keep your account secure. Anyone who can read your email can sign in, so protect access to your inbox. If you think someone else is using your account, tell us at info@podstill.ai.
- You need to be at least 16 to use Podstill.
- You can delete your account at any time in the app: tap your avatar in the top bar, then “Delete account”. This deletes your account and the personal data linked to it, as the privacy policy describes. It doesn’t cancel a subscription: do that in your Apple Account settings (see Subscriptions).
AI-generated content
Gists are written by AI from a transcript of the episode. We check quotes and moments against the transcript, but AI makes mistakes: a gist can get facts wrong, leave out something that matters, or misstate what someone meant.
- A gist isn’t professional advice. Nothing in Podstill is financial, investment, legal, tax, medical or other professional advice, even when an episode is about these topics.
- For anything important, listen to the episode itself, and check the facts with a reliable source before you act on them.
- What a podcast says is up to the people who make it. A gist reports what was said in an episode; it doesn’t mean we agree with it.
- If you allow personalization, gists are tailored to what you’ve told us about yourself. You can switch it off at any time (tap your avatar, then “Personalize with AI” under Personalization), and gists are then written for a general listener.
Plans and purchases
Summary time
Every gist uses summary time: the episode’s length, rounded up to the next full minute. A 42-minute, 10-second episode uses 43 minutes. Your monthly allowance is used first, then any other summary time you have. If a summary fails, the time it used goes back to you.
Free plan
Every account gets 3 hours of summary time for free, once. Like top-up time, it doesn’t expire.
Subscriptions
- Plus, Premium and Pro are auto-renewing subscriptions, billed monthly or annually.
- Each plan gives you an allowance of summary time every month. Annual plans add it month by month, not all at once.
- Unused allowance expires when the next month’s allowance is added. On Pro, up to 10 hours of unused allowance carry over.
- When a subscription ends, its remaining allowance expires, including time carried over. Free and top-up time stays.
- The app shows what each plan includes, and its price, before you buy.
- A subscription renews automatically at the end of each period unless you cancel it at least 24 hours before the period ends. Your Apple Account is charged for the renewal within the 24 hours before the period ends.
- You manage and cancel subscriptions in your Apple Account settings: on iPhone, open Settings → your name → Subscriptions. After you cancel, your plan stays active until the end of the period you’ve paid for.
Top-ups
Top-ups add 3, 10 or 25 hours of summary time. They’re one-time (consumable) purchases, and top-up time never expires. If Apple refunds a top-up, we remove the part of its time you haven’t used yet.
Payment and refunds
All purchases are in-app purchases through Apple. Apple is the seller: it charges your Apple Account and processes payments and refunds under its own terms. We never see your payment details, and we can’t issue refunds ourselves. To ask Apple for a refund, go to reportaproblem.apple.com.
Changes to plans
We may change what a plan includes, such as its allowance, for future periods. We’ll tell you in the app or by email before a change applies to you, and it never affects a period you’ve already paid for. If you don’t want to continue on the new terms, cancel before your next period starts. Apple tells you about price changes in advance, under its own rules.
Using Podstill
We give you a personal, non-exclusive, non-transferable right to use Podstill for your own, non-commercial purposes for as long as you have an account. The app and its software and design are protected by law and belong to us or our licensors. The podcast content that gists refer to belongs to its owners.
You may not:
- scrape, crawl or copy content or data from Podstill with bots or other automated means,
- copy, decompile, reverse engineer or modify the app, except where the law expressly allows it,
- disrupt or abuse Podstill: overload it, probe it for weaknesses, get around its security, or access it other than through the app,
- sell, license or republish gists, or use them commercially, for example to build a competing product or to train AI models,
- get around plan limits, for example by opening several accounts to get more free summary time, or by manipulating purchases,
- use Podstill to break the law or anyone’s rights.
Availability and changes to Podstill
We work to keep Podstill running smoothly, but we can’t promise that it’s always available or free of errors. It may be offline for maintenance, and it depends on podcast feeds and on services we use: a show can change or remove its feed, and an episode can disappear or turn out impossible to summarize.
We keep developing Podstill and may add, change or remove features, as long as the change is reasonable for you and Podstill keeps doing what you’ve paid for. If we ever shut Podstill down, we’ll tell you well in advance.
Ending
You can stop using Podstill at any time and delete your account in the app. Remember to cancel your subscription in your Apple Account settings too.
We may suspend or close your account if you seriously or repeatedly break these terms, if your use puts Podstill or other people at risk, or if the law requires it. Where we can, we’ll warn you first and tell you why. Either side’s right to end the agreement for good cause isn’t affected.
Liability
We’re liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz).
For slight negligence, we’re liable only if we breach an essential obligation: one that makes the proper performance of these terms possible in the first place and on which you may regularly rely. Our liability is then limited to the damage that is typical for this kind of agreement and was foreseeable when it was made. Otherwise, we aren’t liable for slight negligence.
These limits also apply to the people who act for us. Your statutory rights if Podstill is defective aren’t affected.
Governing law and disputes
These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. If you’re a consumer, this choice doesn’t take away the protection of the mandatory laws of the country where you usually live.
We’re neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If something goes wrong, write to info@podstill.ai and we’ll try to sort it out.
If any part of these terms is invalid, the rest stays in effect.
Changes to these terms
We may update these terms, for example when we add features, change our plans, or the law changes. If a change affects you, we’ll tell you in the app or by email before it takes effect, and ask for your agreement where the law requires it. If you don’t agree, you can stop using Podstill, delete your account and cancel your subscription. The date at the top shows when these terms last changed.
Apple App Store terms
If you got Podstill from Apple’s App Store, these points also apply. Where they conflict with the rest of these terms, they take precedence for your use of the app.
